<p>As the Wall Street Journal editorial board writes:A President has the power to make a recess appointment, and we&#8217;ve supported Mr. Obama&#8217;s right to do so. The Constitutional catch is that Congress must be in recess.The fact that three of these appointments were for the National Labor Relations Board — a federal bureaucracy that has already lost all credibility due to its blatant leaning in favor of Big Labor –  adds insult to injury. Even worse, the president only sent the names of the pro-union NLRB nominees to the Senate at the 11th hour, effectively prohibiting any thoughtful consideration of their qualifications.</p>
<p>Rather than working with the Senate to name board members that would restore the agency&#8217;s fairness and credibility, the Administration’s appointments will only embolden an agency that is already out of control.</p>
<p>The federal overreach has gotten out of hand.</p>
<p>It’s time to say enough is enough&#8230; How many Laws do these people gave to break before Americans stand up and say STOP !!  </p>

<p>                            Encourage Congress to Pass the Workplace Democracy and Fairness Act </p>
<p>According to the Friends of the U.S. Chamber, Congress is about to fight back against the overreach of the unelected bureaucrats at the National Labor Relations Board (NLRB) &#8211; and your help is needed.</p>
<p>The House is expected to vote this week on the Workforce and Democracy Fairness Act (H.R. 3094) &#8211; and we ask that you email your members of Congress to urge them to support this common sense bill.</p>
<p>This bill is designed to fight back against the NLRB&#8217;s efforts to end-run Congress to enact a radical, anti-business agenda. They have tried everything from attempting to limit the ability of employers to exercise their free speech rights to giving businesses less time to respond to unionizing efforts.</p>
<p>It would block the NLRB&#8217;s proposed &#8220;ambush election rule&#8221; by providing for fair representation hearing processes and guarantee that employees have ample opportunity to hear both sides of the debate before casting their ballots in a representation election. </p>
<p>It would also codify the long-standing criteria that the Board has traditionally used for determining the appropriateness of a proposed bargaining unit.</p>

<p>For weeks, press reports indicated the so-called &#8220;Occupy&#8221; movement was infested with union agitators seeking to create a climate for more government spending and more forced unionism.</p>
<p>In a report from the Washington Examiner Police Chief Cathy Lanier says :</p>
<p>&#8220;That is no longer a peaceful protest,&#8221; explained D.C. police chief Cathy Lanier, <a title="Who Occupy's the Wall Street Movement ?" href="http://washingtonexaminer.com/blogs/capital-land/2011/11/dc-police-chief-said-occupy-protesters-getting-more-violent">reports the Washington Examiner</a> Lanier stated that the Occupiers have become more &#8220;confrontational and violent toward uninvolved bystanders and motorists&#8221; and even &#8220;jeopardized the safety of their own children by using them in blockades.&#8221;</p>
<p>You see, ever since the Supreme Court&#8217;s infamous 1973 Enmons decision, union bosses have been granted immunity from prosecution for acts of violence and vandalism they orchestrate in the so-called &#8220;pursuit of legitimate union objectives.&#8221;</p>
<p>This outrageous loophole in federal law has effectively tied the hands of federal law enforcement officers and has permitted union bosses and their handpicked &#8220;enforcers&#8221; to achieve their union goals – by any means necessary.</p>

<p>Union workers in Missouri recognize that the EPA’s aggressive push will cost consumers more money while threatening to destroy jobs.</p>
<p><a title="Who is fighting Obama's Job killing EPA Rules ?" href="http://www.chamberpost.com/2011/09/epa-regulation-kills-500-jobs/" target="_blank">The Chamber of Commerce </a>has been screaming about the EPAs jobs-strangling regulation for months. Bill Kovacs, Senior VP of science, technology and regulatory affairs testified before a Congressional Committee last summer:The cumulative impact of regulatory action can be overwhelming:  agencies literally have the power to decide the fate of firms and entire industries.  American Electric Power Co. made headlines last month when it disclosed that EPA’s “train wreck” of coal industry regulations—Coal Ash, Utility MACT, the Transport Rule and Cooling Water Intake structures—would force the utility to retire 6,000 megawatts of coal-fired generating capacity and spend another $6 billion to $8 billion reworking the rest of its fleet.  AEP would close three power plants in West Virginia, one in Ohio and one in Virginia, and would retire several boilers at coal plants in Indiana, Kentucky, Ohio, Texas and Virginia.  </p>
<p>     Unions are against the new EPA rules. Governors and utility companies are fighting it in the courts. Benjamin Quayle (R-AZ) introduced <a title="Will the new NLRB Riule be Rescinded" href="http://lrionline.com/conservatives-challenge-posting-rule" target="_blank">a bill to repeal the rule</a> requiring employers to post a new federal notice of an employee’s right to organize, which is scheduled to go into effect on Nov. 14<sup>th</sup>.  The Employee Workplace Freedom Act would rescind this rule.<a href="http://www.freedom2work.com/wp-content/uploads/right_to_work-2.jpg"><img class="alignleft size-thumbnail wp-image-244" title="right_to_work-2" src="http://www.freedom2work.com/wp-content/uploads/right_to_work-2-150x150.jpg" alt="" width="150" height="150" /></a></p>
<p> Several business groups are also adding their weight to the contest, in the form of legal action. The U.S. Chamber of Commerce <a title="Will the new NLRB Rule be Rescinded" href="http://www.courthousenews.com/2011/09/21/39944.htm " target="_blank">filed a new lawsuit</a> against the new posting rule, claiming the NLRB failed to perform an Initial Regulatory Flexibility Analysis before seeking public comment on the rule.</p>

One important fact is that most PLA will cost 15 percent more that a contract without a PLA. </p>
<p>According to a new study released by the National University System Institute for Policy Research (NUSIPR), California school construction projects built using <a href="http://thetruthaboutplas.com/2009/04/24/project-labor-agreement-basics-what-is-a-pla/">project labor agreements</a> (PLAs) experienced increased costs of 13 percent to 15 percent, or $28.90 to $32.49 per square foot, compared to projects that did not use a PLA.</p>
<p>The findings of the NUSIPR study are particularly important because California voters have approved $64 billion in school construction bonds during the past decade and several school districts have adopted the use of PLAs on these projects.</p>
<p>Typical PLAs are pre-hire contracts that require projects be awarded only to contractors and subcontractors that agree to:</p>
<ul>
<li>recognize unions as the representatives of their employees on that job</li>
<li>use the union hiring hall to obtain workers</li>
<li>obtain apprentices exclusively from union apprenticeship programs</li>
<li>pay into underfunded and mismanaged union pension and benefit plans</li>
<li>obey costly, restrictive and inefficient union work rules</li>
</ul>
